Terms of Service

1. Introduction
The MoneyFormula service provides a tool that helps Australian individuals manage and organise their personal
finances and is operated by Home Money Manager Pty Ltd ATF HMM Trust ACN 129 705 406 trading as Home Money Manager
ABN 32 984 975 651 ("MoneyFormula", "Home Money Manager", "we", "our" or "us"). By accessing or using MoneyFormula,
you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must cease using
MoneyFormula immediately.
2. Acceptance of Terms
By creating an account or otherwise accessing or using MoneyFormula, you acknowledge that you have read, understood,
and agree to be bound by these Terms. These Terms constitute the entire agreement between you and Home Money Manager and
govern your use of the service. You acknowledge that you have not relied on any statement, representation, assurance
or warranty other than those expressly set out in these Terms.
We reserve the right to update these Terms at any time. We will notify you of any material changes to these Terms
via a notification within the MoneyFormula app or by email to your registered email address. Your continued use of
MoneyFormula after such notification constitutes your acceptance of the revised Terms. We encourage you to review
these Terms periodically for any changes.
3. Service Overview
MoneyFormula is an Australian service that provides tools to help you manage and organise your personal finances,
but it does not offer financial, legal, or tax advice. You should consult with a financial advisor or accountant
before making any financial decisions based on the information provided by MoneyFormula.
4. Data Privacy & Security
The handling of your personal information is governed by our Privacy & Security Policy, which is available on the
Home Money Manager website (at "homemoneymanager.com.au"). The Privacy & Security Policy explains how we collect, use,
store, and protect your personal information, as well as your rights regarding your data.
By using MoneyFormula, you agree to the collection and use of information in accordance with our Privacy & Security
Policy. It is your responsibility to ensure that the storage and access to the data input into MoneyFormula complies
with all laws applicable to you.
5. Account Registration
Your MoneyFormula account must be registered by a human residing in Australia. Accounts automatically registered by
"bots" or other methods, or originating from countries other than Australia, are not permitted. Additionally, you must
be 16 years of age or older to register for MoneyFormula.
You agree and understand that you are responsible for maintaining the confidentiality of your password which, together
with your email address, allows you to access MoneyFormula.
You agree to notify us if you change your email address so that we can update our records. You acknowledge that all
official notices and communications from us will be sent to your registered email address. Any notice sent to your
registered email address will be deemed to have been received when sent.
6. Use of the Service
Your access and use of MoneyFormula may be interrupted from time to time for any of several reasons, including,
without limitation, the malfunction of equipment, periodic updating, maintenance or repair of MoneyFormula or other
actions that Home Money Manager, in its sole discretion, may elect to take.
You acknowledge that the MoneyFormula service is only available in Australia, to individuals who reside in
Australia, and that access is only provided while you are physically in Australia.
You warrant that you will not access or use MoneyFormula in any unlawful manner, for any unlawful purpose or in
violation of these terms of service or applicable laws, rules and regulations. You agree that you will be responsible
for all usage of MoneyFormula through your account.
You agree not to use MoneyFormula in any way that could damage, disable, overburden, or impair our servers or
networks, or interfere with any other party's use of MoneyFormula.
You agree that you will not use any robot, spider, scraper, deep link or other similar automated data gathering
or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor MoneyFormula or any
portion of MoneyFormula.com.au, without Home Money Manager's express written consent, which may be withheld in
Home Money Manager’s sole discretion.
You agree that you will not attempt to decipher, decompile, disassemble, or reverse-engineer any of the software
comprising or in any way making up a part of MoneyFormula.
7. Purchasing an Account Top-Up
7.1. Paid Top-Up Months: MoneyFormula offers a paid plan that allows you to access the MoneyFormula service.
By purchasing Top-Up months, your account access end date to MoneyFormula will be extended by the number of
months purchased, and you agree to pay the applicable fees as described at the time of purchase. All fees are stated
and payable in Australian Dollars (AUD) and are inclusive of GST where applicable.
7.2. Payment Terms: A Top-Up is billed in advance based on the number of months you choose to add to your account
access end date, and pay for in one transaction (monthly, three-monthly, six-monthly or annually). You authorise us
to charge your nominated payment method for these fees. This authorisation applies to the specific Top-Up purchase
made by you. MoneyFormula does not operate on an auto-renewal subscription basis for Top-Ups. Each Top-Up purchase
extends your access for the specified period only.
7.3. Expired Access: If your account access end date expires, you will no longer have access to the MoneyFormula
service. You can extend your account access end date by purchasing an account Top-Up.
7.4. Cancellation and Refunds: You may cancel your account access at any time through your account settings
by deleting your MoneyFormula account. If you delete your account, you will not be entitled to a refund for any
unused portion of the Top-Up months remaining, unless you qualify for the 30-Day Money Back Guarantee.
7.5. 30-Day Money Back Guarantee: If within 30 days of purchasing your first Top-Up from MoneyFormula
("Qualifying Period"), you change your mind and no longer wish to use the MoneyFormula service, you can request
a refund. If you request your refund and delete your account within the 30-day Qualifying Period, you will receive a
full refund of the transaction amount you originally paid to MoneyFormula. This refund only applies to your
first MoneyFormula Top-Up purchase and does not apply to subsequent Top-Ups, Gift Codes or Vouchers.
7.6. Changes to Fees: We reserve the right to modify the Top-Up fees at any time. Any changes will take effect the
next time you make a Top-Up purchase.
8. Disclaimers and Limitations of Liability
8.1 No Financial or Tax Advice: MoneyFormula is a tool designed to assist you in managing your personal finances
by providing overviews and insights based on the financial data you provide. The numbers and calculations provided
are estimates only and the information generated by MoneyFormula should not be interpreted as financial or
tax advice. Home Money Manager does not guarantee specific financial outcomes or fitness for a unique, unstated purpose.
The content MoneyFormula provides is based on your input, publicly accessible data and other available
sources. It is intended for informational purposes only and should not be relied upon when making financial or
investment decisions. You should seek independent financial, tax and legal advice tailored to your circumstances
before taking any action.
Although MoneyFormula includes features that may help you pay down debt faster, achieve your savings goals
and identify ways of managing your mortgage, the output should not be considered financial or tax advice. Home
Money Manager is not a registered tax agent, or registered to provide financial advice, and the information
provided does not substitute professional financial or tax advice. You are responsible for ensuring compliance
with all relevant accounting, tax, and legal obligations. It is your responsibility to verify that the data you
store and access through MoneyFormula is handled in accordance with applicable laws.
While MoneyFormula is designed to assist with organising your finances, we do not warrant or guarantee that the
service will meet your specific financial needs or achieve any particular financial outcome or result. The service
is provided with due care and skill, but its effectiveness is entirely dependent on the accuracy of your input
and your personal financial decisions. You acknowledge that you have not communicated to us, and we do not
warrant, that MoneyFormula is fit for any specific or particular purpose beyond its general stated functionality
as a personal financial management tool.
8.2 Service Availability: MoneyFormula is provided to you on an “as is” and “as available” basis. We do not
guarantee that MoneyFormula will function without interruptions or errors, and we do not warrant that the
service will meet your specific needs. Access to MoneyFormula and its services may be subject to interruptions
and any reliance on the service is at your own risk.
We also do not guarantee that any third-party services integrated with MoneyFormula will function as
intended. Any information transmitted between you and MoneyFormula is done at your own risk, and we accept no
responsibility for any damage or interference to your computer systems or data as a result of using MoneyFormula.
Unless otherwise expressly stated, MoneyFormula does not provide any specific service level agreements (SLAs)
regarding uptime or availability. While we strive for high availability, the "as is" and "as available" basis
of the service means we do not guarantee specific performance metrics.
While Home Money Manager implements backup and disaster recovery procedures for the MoneyFormula service, you
acknowledge that MoneyFormula is a tool for managing your personal finances, and you are solely responsible for
maintaining your own independent records and backups of your underlying financial data (e.g., bank statements,
transaction records, original receipts) external to the MoneyFormula service. MoneyFormula is not intended to be
your sole or primary record-keeping system for audit, tax, or legal purposes. We are not responsible for any loss,
corruption, or unavailability of data resulting from your failure to maintain such external records, or from events
beyond our reasonable control, including but not limited to failures of third-party infrastructure providers.
8.3 Limitation of Liability: Nothing in these Terms excludes, restricts or modifies any guarantee, warranty,
term or condition implied or imposed by the Australian Consumer Law or any other applicable legislation which cannot
lawfully be excluded or limited.
To the maximum extent permitted by law, Home Money Manager disclaims any liability for damages, losses, or expenses incurred
directly or indirectly from the use or inability to use our services, including, but not limited to, any loss of data,
profits, revenue, or savings, unless such loss or damage is due to our breach of these Terms, negligence, or a failure
of a consumer guarantee that cannot be excluded by law.
In cases where our liability cannot be excluded but can be limited, our liability for a breach of these Terms, or for
a failure to comply with a consumer guarantee, is limited, at our option, to (a) the supplying of the services again; or
(b) the payment of the cost of having the services supplied again.
Any liability on our part is reduced to the extent that your actions or inactions contributed to the loss or damage.
Our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of
MoneyFormula, whether in contract, tort (including negligence), under statute, or otherwise, is limited to the
Top-Up fees paid by you in the twelve (12) months preceding the incident that gave rise to the claim.
8.4 Indemnification: You agree to indemnify MoneyFormula and hold us harmless against any claims, losses,
or expenses (including legal fees) that arise from your use of our service in violation of these Terms. This
includes any claims related to the misuse of data or any third-party rights infringements, or any breach of your
warranties under these Terms. This indemnification obligation is separate from and in addition to any other
remedies available to us, and is not subject to the limitation of liability set out in clause 8.3.
9. Intellectual Property
Home Money Manager retains all rights, title, and interest in and to the MoneyFormula service, including
all intellectual property rights. You may not use MoneyFormula's content or materials for any commercial
purposes without our prior written consent.
10. Termination
We reserve the right to terminate or suspend your MoneyFormula account at our sole discretion if you violate
these Terms or engage in any conduct that we deem harmful to the service or other users.
In addition, we reserve the right to delete your MoneyFormula account and associated data from our systems at
our sole discretion, where the account has been inactive or expired for more than three months.
You may terminate your MoneyFormula account at any time through the MoneyFormula service by choosing to delete your account.
11. Governing Law
These Terms are governed by the laws of Western Australia. Any disputes arising from these Terms or your use
of MoneyFormula will be subject to the non-exclusive jurisdiction of the courts of Western Australia.
12. General Provisions
12.1. Force Majeure: Neither party will be liable for any delay or failure in performance of its obligations
under these Terms if such delay or failure is caused by acts of God, war, terrorism, civil commotion, labour dispute,
major internet or cloud service provider failures or delays (including but not limited to those affecting
Amazon Web Services (AWS) or similar infrastructure providers), or any other event beyond the reasonable control of
that party.
12.2. Severability: If any provision of these Terms is found to be invalid, unenforceable, or illegal by a
court of competent jurisdiction, such provision will be severed from these Terms and the remaining provisions will
continue in full force and effect.
12.3. Assignment: You may not assign or transfer your rights or obligations under these Terms without our
prior written consent. We may assign or transfer our rights and obligations under these Terms without your consent
to an affiliate or in connection with a merger, acquisition, or sale of all or substantially all of our assets.
12.4. Feedback: If you provide us with any feedback, suggestions, or ideas regarding MoneyFormula ("Feedback"),
you agree that such Feedback is provided on a non-confidential basis and that we are free to use, modify, and
implement such Feedback without any compensation or attribution to you.
12.5. Entire Agreement: These Terms, together with our Privacy & Security Policy and any other documents
expressly incorporated by reference, constitute the entire agreement between you and Home Money Manager regarding
your use of MoneyFormula and supersede all prior or contemporaneous understandings and agreements, whether written
or oral, regarding such subject matter.
12.6. Headings: The headings used in these Terms are for convenience only and do not affect the interpretation
of the provisions herein.
